Abstract

This case study examines the Passaic River in Northern New Jersey as a powerful example of environmental injustice and its implications for sustainability. Tracing the river’s transformation from an engine of industrial growth to one of the most contaminated waterways in the United States, the paper explores how pollution, discriminatory land-use policies, and delayed remediation efforts have disportionately burdened marginalized communities. Focusing on the Lower Passaic River Superfund Site and the Ironbound District of Newark, it highlights the intersection of environmental degradation, public health, and social equity. The study also examines the role of grassroots advocacy and community-led organizing in advancing environmental justice, arguing that sustainability cannot be achieved without addressing the unequal distribution of environmental risks and benefits.

Introduction: Justice as the Foundation of Sustainability

The pursuit of a sustainable future is a pursuit of justice. At its core, justice in this context is the fair and equitable distribution of environmental benefits and burdens, ensuring meaningful participation for all communities in the decisions that shape their environment, and recognizing the inherent dignity and rights of every person, particularly those historically marginalized. Its antithesis, injustice, is the systemic violation of these principles, where political and economic structures deliberately or negligently concentrate pollution and health hazards in specific communities while systematically excluding them from the political and economic benefits. This framework is not outside of sustainability, it is its very foundation.


The basic “Three Pillars of Sustainability”, environmental, economic, and social, collapse without it. An environmental cleanup that is delayed for decades in a low-income community, an economic system that profited from polluting a minority neighborhood and then skirts the full cost of restoration, and a social system that denies certain groups a voice are all unsustainable. As Dr. Robert Bullard, the foundational scholar of the movement, asserts, “Whether by conscious design or institutional neglect, communities of color in urban ghettos, in rural ‘poverty pockets,’ or on economically impoverished Native-American reservations face some of the worst environmental devastation in the nation” (Bullard, 1994). This inequity creates societal conflict, kills public trust, and births health crises that ultimately impose costs on everyone. Justice is the element that fortifies the social pillar, allowing it to bear the weight of the other two and create a more resilient and equitable system.

The Passaic River: A Landscape of Contradictions

A powerful case study that showcases this broken system is the ongoing environmental catastrophe of the Passaic River in Northern New Jersey. The river I grew up alongside, Pennington Park, the Great Falls, and Goffle Brook, but we knew not to touch. This 90-mile river, winding from picturesque headwaters in Two Bridges, NJ to the heavily industrialized Newark Bay, serves as a liquid timeline of industrial progress and its profoundly unjust consequences. The story culminates in the Lower Passaic River, a federally designated Superfund site, and its fenceline communities, most notably the Ironbound District of Newark. The Ironbound, a neighborhood whose name derives from the railroad tracks that bind it on three sides and the polluted river on the fourth, is a stark landscape where homes, schools, and parks exist in the literal shadow of polluting industrial facilities, a testament to the intimate and dangerous proximity forced upon my hometown community.

Industrial Development, Toxic Legacy, & Frontline Communities

The origins of this injustice are deeply rooted in the Industrial Revolution. The city of Paterson, at the river’s Great Falls, was established as the nation’s first planned industrial city, its mills producing textiles, locomotives, and firearms while dumping a century’s worth of untreated chemical dyes, heavy metals, and other waste directly into the waterway. The situation escalated from chronic pollution to catastrophic contamination between 1951 and 1969 at the Diamond Alkali plant in Newark. This facility manufactured Agent Orange, the defoliant used in the Vietnam War, and in the process produced dioxin (TCDD), one of the most toxic compounds ever synthesized by science. An estimated 100 pounds or more of dioxin were discharged into the Passaic, joining a “toxic soup” of PCBs, mercury, and pesticides from countless other facilities. The legacy of this poisoning is a riverbed lined with 1.5 to 2 million cubic yards of contaminated sediment. In some of the most heavily polluted stretches, dioxin levels have been measured at a staggering 51,000 parts per trillion. For context, the US Environmental Protection Agency considers 1.2 parts per trillion to pose an elevated cancer risk (EPA). This has resulted in a total “Do Not Eat” advisory for all fish and crabs from the river, severing a vital cultural and recreational connection for the community. This historical burden is compounded by ongoing pollution, as the Ironbound also hosts one of the nation’s largest sewage treatment plants, a massive waste-to-energy incinerator, and intense traffic from Port Newark, creating an impact that is almost unimaginable in wealthier, whiter communities. The human toll of this environmental failure is immense, disproportionately affecting hundreds of thousands of people within the watershed. The most acute impact is felt by the roughly 50,000 residents of the Ironbound District and the densely populated, predominantly minority communities in cities like Paterson, Kearny, and Elizabeth along the river’s lower stretch. These populations face exposure pathways through contaminated dust, airborne emissions from ongoing industrial activity, and the persistent threat of flooding, which can disturb toxic sediments from the riverbed and deposit them into streets, parks, and basements (Hurricane Sandy).

Responsibility and Systemic Discrimination

Assigning responsibility for this crisis reveals a complex web of past and present entities. The direct legacy polluters include Occidental Chemical Corporation, the successor to Diamond Alkali, which is considered the primary responsible party. They are joined by over 100 other “Potentially Responsible Parties” (PRPs), a roster of corporate giants like BASF, Pfizer, and Honeywell, whose operations contributed to the contamination. Government agencies, specifically the US EPA and the New Jersey Department of Environmental Protection (NJDEP), also share blame for a cleanup process that has been painfully slow and often inadequate. The site was listed on the National Priorities List in 1984, but a final cleanup plan for the most contaminated section was not settled until 2016, with full implementation still years away. Ultimately, the root cause is systemic discrimination. A historical zoning and policy framework that deliberately designated low-income, immigrant, and minority neighborhoods as “sacrifice zones” for the region’s unwanted industrial and waste infrastructure.

The types of discrimination present are textbook examples of environmental racism and economic injustice. Racially and ethnically, the Ironbound is a majority-Latino community (approximately 50%) with large Portuguese and Brazilian immigrant populations, while Paterson is also a majority-minority city. These communities were targeted precisely because they had limited political power and often faced language barriers that hindered effective organizing. Economically, the affected areas have poverty rates significantly higher than state and national averages, meaning residents lack the financial resources to relocate or mount costly legal challenges, rendering them vulnerable to bear the burden of the state’s pollution.

Community Resistance and Environmental Justice

In the face of this monumental challenge, a powerful history of resistance has emerged. The Ironbound Community Corporation (ICC), founded in 1969, stands as a national model for community-based environmental justice organizing. The ICC has fought for and won tangible victories, from creating cleaner parks and enacting lead-safe housing laws to securing greater community oversight of industrial permits. This grassroots advocacy has been complemented by decades of legal and political action, with community groups and state attorneys general engaging in protracted litigation to force polluters to pay for the cleanup. A formal Passaic River Superfund Community Advisory Group (CAG) was established to ensure residents have a direct and structured voice in the cleanup negotiations, consistently advocating against partial solutions and for a comprehensive restoration that actually protects public health.

Conclusion

The struggle for the Passaic River is a reminder that a sustainable future is impossible without justice, demanding a collective, equitable, and urgent response to the poisons of the past. The gritty, fighting spirit of the people who live and love in this corner of our country is what gives me hope that a better future along the Passaic River is absolutely worth working towards.
